Terms of Service

1. Acceptance of Terms

By accessing or using the Oto mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Community Guidelines. If you do not agree to these Terms, please do not use the Service. "Oto," "we," "our," and "us" refer to the operator of the Service.

2. Description of Service

Oto is an app for recording motorcycle rides and sharing them with other riders. It lets you record rides, view statistics about them, add photos, publish and save routes, and follow and interact with other riders. We may modify, suspend, or discontinue any part of the Service at any time.

Parts of the Service may be offered as a beta or test version. Beta features may contain errors, may change, and may be removed without notice.

3. User Accounts and Registration

3.1 Account Creation

To use most features of the Service, you must create an account with a phone number you can verify. You agree to:

• Provide accurate, current, and complete information
• Use only a phone number that belongs to you
• Keep access to your account and device secure
• Accept responsibility for all activities under your account

3.2 Eligibility

You must be at least 13 years old (or a higher minimum age where required by local law) to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. Riding Safety

Motorcycling is dangerous. You are solely responsible for how you ride. By using the Service, you acknowledge and agree that:

• Operating the app while riding a motorcycle or driving any other vehicle is dangerous, and you do so at your own risk.
• You are solely responsible for complying with all traffic laws, speed limits, and the rules of any road, track, or trail you ride on.
• The Service does not encourage or reward speeding or reckless riding, and nothing in it should be taken as a reason to ride faster or take more risk.
• Ride statistics such as speed, lean angle, acceleration, distance, and elevation are estimates from your phone's sensors and may be inaccurate. They are not intended for safety, navigation, legal, or insurance purposes.
• Routes and content shared by other users are not checked by us for safety, legality, or road conditions. You ride any route at your own risk.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, threaten, bully, or harm other users
• Share hateful, sexually explicit, violent, or otherwise objectionable content
• Promote or glorify reckless or illegal riding
• Share where other riders live or park, or other personal information about anyone without their permission
• Post content you do not own or have permission to share
• Impersonate others or provide false information
• Attempt to gain unauthorized access to our systems or other users' accounts
• Collect data from the Service by automated means, or interfere with its proper functioning
• Use the Service for commercial purposes without our permission

There is no tolerance for objectionable content or abusive users. You can report content and users, and block users, from within the app. We review reports and may remove content and suspend or terminate accounts that violate these Terms.

6. User Content

6.1 Your Content

You retain ownership of the content you submit to the Service, including rides, routes, photos, and comments ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to resize photos or hide parts of routes according to your settings), and display your User Content, solely to operate, provide, and improve the Service and in accordance with your privacy settings. This license ends when you delete the User Content or your account, except for content others have already saved or shared as the Service allows, and copies we must keep by law.

6.2 Content Standards

All User Content must comply with these Terms, our Community Guidelines, and applicable laws. You are responsible for your User Content. We reserve the right, but have no obligation, to review, remove, or restrict any content that violates these Terms or our policies.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

8. Intellectual Property

The Service and its original content, features, and functionality, excluding User Content, are owned by Oto and are protected by copyright, trademark, and other intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

9. Third-Party Services

The Service includes maps, weather, and other content provided by third parties. Such content is provided as-is, may be inaccurate or incomplete, and is subject to the third parties' own terms. We are not responsible for third-party services or content.

10. Paid Features

The Service is currently free. If we offer paid features in the future, they will be described in the app, and purchases will be made through the App Store and subject to its terms, including its refund policies.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT RIDE DATA OR STATISTICS WILL BE ACCURATE, OR THAT YOUR DATA WILL NEVER BE LOST.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR RIDING OR YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold harmless Oto from any claims, losses, damages, or expenses, including reasonable attorneys' fees, arising from your use of the Service, your User Content, your riding, or your violation of these Terms.

14. Termination

You may stop using the Service and delete your account at any time from the app's settings. We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive, including Sections 6, 8, 11, 12, 13, 15, and 16.

15. Apple App Store

If you downloaded the app from Apple's App Store, you also acknowledge and agree that:

• These Terms are between you and Oto only, not Apple, and Oto, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, or consumer protection claims.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo, and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page, updating the "Last Updated" date above, and notifying you through the Service. Your continued use of the Service after changes take effect means you accept the updated Terms.
